Terms and Conditions

All products made by By Sil Pâtisserie (We/‘we’) are subject to the following Terms and Conditions. Both Cake and Desserts are referred as ‘cake(s).

Consent

By placing an order and completing the checkout process, you are agreeing to the terms and conditions set out below.

We reserve the right to refuse the sale of goods or services or to cancel an order under certain circumstances.

Ingredients and Allergies

All our ingredients are of the highest quality.

All cakes, fillings and icings may contain, or come into contact with, soy, wheat/gluten, egg dairy, nuts or other allergens even though these ingredients do not exist in the product.

It is the responsibility of the buyer to review the cake ingredients and choose according to their allergy situation. We will not be held responsible for any allergic reaction resulting from consumption of the cake.

Our kitchen is not certified Gluten Free.

Payment

Payment will be made at time of order placement. Custom orders, wholesale customers payment terms will be agreed prior to order placement.

Orders And Confirmation

Please ensure all contact details, delivery details are correct and any specific requirements on order confirmation. notify us via Email immediately of any errors.

Cancellation/Change of Date

If you wish to cancel within 12 hrs of order placement, a full refund will be made.
If the order is cancelled after 12 hours, and the cake preparation has begun a 50% refund will be provided.

If the cake or dessert has already been completed, a refund on the cancellation, unfortunately cannot be offered.

If a change of date and/or time is requested, send us a request via email and every attempt will be made to accommodate the request. However it can not be guaranteed given existing orders and delivery. An additional $10 fee may be charged for the change at our discretion discussion.

Cancellations, Or Change Due To COVID

If you are currently booked with us and wish to reschedule or downsize your order due to Covid, then we can accommodate you, with no penalty. If you are not able to do this, and wish to cancel completely, then you are welcome to a full refund. However, we require at least 48 hours notice for this option.

Cancelling less than 48 hrs voids the option of a refund. Please be mindful, many hours may go into making our cakes and desserts. If the cake is not yet complete, we may be able to give a “partial” credit/refund.

Returns

Because of the perishable nature of our products we do not accept returns. However, if you are not entirely satisfied with the purchase please contact us immediately explaining what are your issues. We can then evaluate the issue and make it right.

Unforeseen Circumstances

If we have to cancel the order with you for any particular reason due to health, family or situations out of our control, a full refund will be provided to you.

Storage

The cakes and dessert produced are delicate and perishable. They require appropriate storage to ensure their flavour and structure is maintained and to avoid spoilage. Each cake has specific storage requirements, particularly when decorated and the buyer should read these for its storage requirements.

We are not responsible for any loss of colour, taste or form of the cake, nor any spoilage due to inappropriate storage while under the customer’s responsibility.

Damage

The customer assumes ALL liability and responsibility for the condition of the product once it leaves our possession.

Delivery

Delivery is provided by By Sil Pâtisserie. Delivery fees are set out on our website. The fees charged are at our discretion and may change at any time.

It is the responsibility of the buyer or their authorised representative to be at the delivery location for the period indicated in the delivery window. If the buyer is not present when we arrive, we will contact the customer and try to organise a workable delivery alternative. If none cannot be found the cake will be returned and no refund will be issued. We have discretion to charge a fee for a major alteration.

The cake cannot be left with an unauthorised person or unattended location, due to the perishability of the cake.

Every attempt will be made to deliver in the specified delivery window, but we will not be held responsible if delivery cannot be made during the time window. We will contact the buyer as soon as possible to advise the approximated delivery time.

Photographs

We reserve the right to take and use photographs of your cake(s) and desserts, before, during and after any presentation, for marketing, advertising, and promotional purposes, without compensation to you.

Variations From Picture

The cake or dessert may vary slightly from what is pictured on our website. The unavailability of seasonal ingredients means alternative ingredients and decorations may be used, which alter the visual look of the cake. This variation is not a valid reason for a return.
